These Terms of Service ("Terms") govern your access to and use of Scamminder.com, its related applications, browser extensions, and APIs (collectively, the "Services"), operated by ScamMinder AI Trust LLC ("ScamMinder," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

ScamMinder provides automated, AI-generated assessments of websites for potential scam, fraud, and security-risk signals, along with related content and optional paid services. The nature and limitations of these assessments are described in our Disclaimer, which is incorporated into these Terms by reference.

2. Scores are opinion, not fact

You understand and agree that all scores, ratings, labels, and reports produced by the Services are statements of ScamMinder's opinion based on automated analysis and available data, and are not statements of verified fact or a definitive determination about any website, business, or person. You agree not to represent our results as anything other than an automated, opinion-based assessment.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for the accuracy of the information you provide and for all activity under your account. You must keep your credentials secure and notify us of any unauthorized use.

4. Acceptable use

You agree not to:

  • use the Services to harass, defame, extort, or unlawfully harm any person or business;
  • scrape, copy, resell, or redistribute our data, scores, or reports except as expressly permitted;
  • interfere with, overload, or attempt to gain unauthorized access to the Services or our systems;
  • use automated means to access the Services except through our official API and within its documented limits;
  • misuse our results to mislead others about the legitimacy of any website.

5. API and paid services

If you use our API or purchase any paid service, additional documented limits, pricing, and usage rules apply. Paid services (including expert analysis) provide additional review or functionality only. Payment never buys a higher trust score, removal of a rating, or any guaranteed outcome. Fees are non-refundable except where required by law or expressly stated at the time of purchase.

6. Website owner re-review

Owners and representatives of listed websites may request a free re-review of an assessment they believe is inaccurate or outdated, as described in our Disclaimer. We aim to correct genuine errors regardless of whether any paid service is purchased.

7. Intellectual property

The Services, including our software, algorithms, design, text, and the compilation of our data, are owned by ScamMinder AI Trust LLC and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved.

8. User submissions

If you submit reviews, reports, or other content, you grant us a worldwide, royalty-free license to use, display, and distribute that content in connection with the Services. You are responsible for what you submit and represent that it is accurate and lawful. We may moderate, edit, or remove submissions at our discretion.

9. Disclaimers and limitation of liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, RELIABILITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. To the maximum extent permitted by law, ScamMinder AI Trust LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, and our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or USD 100.

10. Indemnification

You agree to indemnify and hold harmless ScamMinder AI Trust LLC and its owners, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Services or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to that venue.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
